Texas Family Code


The underlying assumption in Texas is that all assets owned during the marriage are community assets and therefore divisible between the divorcing individuals; however, the Texas Family Code does recognize separate property assets depending on how and when they were acquired. Separate property assets remain the property of the spouse claiming separate property and are therefore not divisible between the spouses.

Further, the Texas Family Code clarifies that the individual making a separate property claim must provide clear and convincing proof of separate property ownership.
